For the past 25 years, I have represented both plaintiffs and defendants in civil cases, concentrating in both personal injury and commercial litigation matters. I have learned, sometimes the hard way, that the courtroom is often not the place to find justice.

The best solutions are the ones that parties can achieve by agreement. Litigation often benefits only those who make a living from conflict. Encouraging parties to meet and talk over their differences is a major first step in dispute resolution. Once this idea finds acceptance, mediation can be an ideal device to solve problems and let people avoid unrewarding, if not damaging, litigation.

Once the true causes of contention are identified and then discussed openly, cases can be more efficiently and less dramatically concluded. With mediation, there is no need for ‘winners’ or ‘losers’, and none of the risks associated with verdicts. Mediation provides a low-key method of dispute resolution that can significantly reduce the stress and costs of litigation for all concerned. However, when parties determine that they cannot successfully reach an agreement even with mediation, they may elect arbitration in order to obtain closure and finality. I am frequently asked by my peers and recommended by judges to serve as an arbitrator to provide a cost-effective and fair alternative to trial.

David L. Murphy graduated from Albany Law School after receiving his Bachelor of Arts degree from St. John Fisher College. He was admitted to practice before all the Courts in the State of New York and United States District Courts in 1978. He was a prosecutor in the Monroe County District Attorney’s Office, and is now the managing partner of WeinsteinMurphy. He is a member of the New York State and Monroe County Bar Associations, the New York State Academy of Trial Lawyers and the ABA Section of Dispute Resolution. He received mediation training at the national headquarters for the Center for Dispute Settlement, and has served on numerous arbitration panels at the request of his peers. Since 2000, he has served as an arbitrator for civil cases assigned to Rochester City Court, Small Claims Division.
